CORTIÑAS, Judge.

The Appellee, Manuel Calderon, was charged with first degree murder and conspiracy to commit first degree murder. He was acquitted on the murder count but was convicted of conspiracy to commit first degree murder. Calderon challenged his conviction by arguing that the conspiracy prosecution was barred by the statute of limitations. The trial court agreed with Calderon and dismissed the conspiracy count.
