This appeal arises out of an action by the plaintiff, Emellie Anderson, to recover damages from the defendant, Kenneth Whitten, for unsatisfactory performance of two home improvement contracts. The trial court found the defendant liable under a theory of common-law negligence and awarded the plaintiff $10,000. On appeal, the defendant argues that (1) the complaint did not properly state a claim of negligence, (2) the court improperly credited the testimony...
