Rogers & Willard, Inc. ("R & W"), appeals from an order of the Baldwin Circuit Court denying its motion for an award of attorney fees. Dr. Brent Harwood cross-appeals from an order granting R & W's motion for an award of costs and from orders denying Harwood's postjudgment motion for a judgment as a matter of law ("JML") or, in the alternative, for a new trial. We reverse as to the appeal and affirm as to the cross-appeal.
