I. INTRODUCTION

Martin Diblik sued Scott Marcy after Marcy sold him a house with a defective underground septic tank. Before closing, Marcy signed a statutory disclosure statement in which he stated that, "to the best of [his] knowledge," there were no defects in the septic system.
