Nelson Valdes pled guilty and was convicted of bank fraud, in violation of 18 U.S.C. §§ 1344 and 2, and was sentenced to 108 months of imprisonment, which considerably exceeded the Guidelines range of 41 to 51 months as calculated by the Presentence Investigation Report, as well as the Guidelines range of 57 to 71 months urged by the government on the basis of a two-level criminal history category upward...
