Pending before the court is the defendant United Parcel Services, Inc.'s, ("UPS") motion for judgment on the pleadings (doc. 22) filed with a supporting brief (doc. 23) and evidentiary materials (doc. 24). Plaintiff Barber Auto Sales, Inc., ("Barber") filed a response in opposition to the motion (doc. 28) to which UPS filed a reply (doe. 33).
