JOHNSON, District Judge.

In the second amended complaint filed by plaintiff, Kevin Danley ("Danley"), he invokes 42 U.S.C. § 1983 and seeks damages from five jail personnel who he claims violated his constitutional rights while, he was a pretrial detainee and while they were acting under color of state law. All defendants filed motions to dismiss pursuant to Rule 12(b)(6), claiming that they are entitled to qualified immunity...
