¶ 1. Jack Nofsinger filed a negligence action against Joe Irby in the Circuit Court of Harrison County. Specifically, Nofsinger claimed that while he was under the employ of Irby and using Irby's table saw to cut wooden forms for the construction of a concrete driveway on Irby's rental property, a wood chip was propelled from the blade striking him in the left eye and resulting in permanent loss of vision to the eye.
