¶ 1. The present appeal involves a complaint for legal malpractice filed by Jimmy Lancaster against his attorneys for mishandling the appeal of his conviction of capital murder. This case originated in December 1981 in Chickasaw County when Deputy Robert Kirby went to Lancaster's house to serve him with an arrest warrant and was shot and killed by Lancaster.
