This is an appeal by plaintiff, James Wright, from a summary judgment granted in favor of defendant, D & C Foods, Inc. (incorrectly and improperly named Wendy's International, Inc., d/b/a Wendy's Old Fashioned Hamburgers/Wendy's). For reasons that follow, we affirm.
