{¶ 1} Plaintiff, James A. Smalley, owns land adjacent to and abutting the U.S. Route 30/U.S. Route 23 interchange in Wyandot County. Plaintiff stated that he planted two acres of soybeans in his fields abutting the U.S. Route 30/U.S. Route 23 interchange and that the beans failed to mature during the growing season of 2005.
