In 1990, defendant Elena Scott began dating a man named Phillip Toliver, and the two had a child together in 1992. Toliver physically abused defendant, and she attempted to end the relationship. Toliver's violence escalated with her attempts, culminating in his kidnaping and assaulting defendant in 1999. Toliver was sent to prison, but when he got out in 2004, he began menacing defendant again. In response...
