Gerald Lynn Burgess was charged by indictment with the aggravated rape of a person under the age of 13 years in violation of La. R.S. 14:42. Burgess pled guilty to the reduced charge of simple rape in violation of La. R.S. 14:43 and received a sentence of 20 years at hard labor, without benefit of parole, probation or suspension of sentence. Burgess appeals the imposed sentence as excessive.
