ORDER DENYING DEFENDANTS' MOTIONS TO DISMISS

ZIMMERMAN, United States Magistrate Judge.

Before me are defendants' motions to dismiss plaintiff's complaint for failure to state a claim upon which relief may be granted or, alternatively, for lack of subject matter jurisdiction.1 For the reasons set forth below, defendants' motions are DENIED2
