JOHNSON, Justice.

The defendant now brings his direct appeal of his conviction and sentence to this Court pursuant to La. Const. art. 5, § 5 D1 raising 36 assignments of error. We find merit as to one of the assignments raised by the defendant for the reasons set forth more fully below. Therefore, we reverse and vacate the conviction and death sentence, and remand for a new trial.
