The Supreme Court of the United States ("U.S. Supreme Court") vacated our judgment previously rendered in Grefer v. Alpha Technical, 2002-1237 (La.App. 4 Cir. 3/31/05), 901 So.2d 1117, and remanded the matter for our further consideration in light of its decision in Philip Morris USA v. Williams, 549 U.S. ___, 127 S.Ct. 1057, 166 L.Ed.2d 940 (2007).1
