BACKGROUND

This vigorously contested matter was the subject of a trial to the court relating to the claim of the plaintiff, Edward Socha, Jr., for trespass and for an injunction. The writ, summons and complaint was filed in 2001, alleging among other things that the defendant, Scott Bordeau, constructed and maintained a dock on property the plaintiff owned under the water in front of the defendant's upland property.
