¶ 1 After pleading guilty, petitioner Alejandro Romero was convicted of promoting prison contraband, a class two felony, and sentenced to a presumptive term of five years in prison. Romero filed a notice of post-conviction relief pursuant to Rule 32, Ariz. R.Crim. P., 17 A.R.S., and in his petition for post-conviction relief argued his sentence was illegal.
