Now before the Court is Defendant's motion for summary judgment. Fed. R.Civ.P. 56; (Doc. 34). Plaintiff has alleged a claim pursuant to 42 U.S.C. § 1983 and a state law claim for false imprisonment. The Court has jurisdiction pursuant to 28 U.S.C. § 1331 and § 1367.
