¶ 1 This matter came to the trial court as a result of dueling motions for summary judgment in a declaratory judgment action concerning insurance coverage. Plaintiff Kathleen Gula suffered a work injury, and alleged the injury was compounded because the workers' compensation case manager assigned by the employer's carrier, Novaeon, delayed authorization of surgery.
