H.T. v. STATE

No. 3D07-873.

967 So.2d 374 (2007)

H.T., a juvenile, Appellant, v. The STATE of Florida, Appellee.

District Court of Appeal of Florida, Third District.

October 17, 2007.

Attorney(s) appearing for the Case

Bennett H. Brummer, Public Defender, and Valerie Jonas, Assistant Public Defender, for appellant.

Bill McCollum, Attorney General, and Heidi Milan Caballero, Assistant Attorney General, for appellee.

Before RAMIREZ, SUAREZ, and ROTHENBERG, JJ.

ROTHENBERG, Judge.

H.T., a juvenile, appeals from an order withholding adjudication of delinquency, placing him on probation, and ordering payment of recovery costs and attorney's fees. Because we conclude that the trial court erred in failing to conduct a Richardson1 hearing, and we cannot conclude that the error is harmless, we reverse and remand for a new trial.
