INTRODUCTION

The issue before this court is whether it should dismiss the complaint as to the named defendant pension and retirement board (board) of the city of Milford (city) for lack of subject matter jurisdiction. As no enabling statute exists establishing that the board is a legal entity separate from the municipality itself, it cannot be sued. Accordingly, this court grants the defendants' motion to dismiss.
