I. Introduction

Plaintiff Tennessee Walking Horse Breeders' and Exhibitors' Association ("TWHBEA") filed this action against Defendant National Walking Horse Association ("NWHA"), alleging copyright infringement in violation of 17 U.S.C. § 101, et seq. (the "Copyright Act"), trademark infringement in violation of § 1114(1) of the Lanham Act, 15 U.S.C § 1051, et seq.
