Following his conviction for conspiracy to distribute and possession with the intent to distribute at least fifty grams of crack cocaine, Defendant-Appellee Jason Leatch received the minimum 324-month sentence under the then-mandatory sentencing guidelines. In the wake of United States v. Booker, 543 U.S. 220, 125 S.Ct. 738, 160 L.Ed.2d 621 (2005), this court vacated Leatch's sentence and remanded for resentencing...
