In August 2006, respondent New York City Department of Environmental Protection (hereinafter DEP) adopted new rules governing the recreational use of water supply lands and waters. These rules applied to all recreational use of New York City lands, lakes and reservoirs owned for water supply purposes, including lands located outside of the metro New York area known as the Watershed.1
