The Port of Vancouver (the Port) and Support Terminals Operating Partnership, L.P. (ST) successfully argued to the Pollution Control Hearings Board (the PCHB) that the permit violated the State Environmental Policy Act (SEPA). We reverse because the permit authorized preliminary testing only and was exempt from SEPA...
