In October 2006, defendant pleaded guilty to a superior court information charging him with two counts of rape in the third degree under Penal Law § 130.25 (2). He was thereafter sentenced to 180 days of incarceration and 10 years of probation. The Board of Examiners of Sex Offenders submitted a risk level assessment instrument to County Court pursuant to the Sex Offender Registration Act (see Correction Law art 6-C) with a score of 115 points...
