Opinion by Justice MOSELEY.
On September 22, 2006, Derrick D. Carson was arrested and charged with possession of a controlled substance in an amount greater than four grams but less than 200 grams. Depending on the controlled substance alleged in the charging instrument, that offense is generally a first-degree felony. See TEX. HEALTH & SAFETY CODE ANN. § 481.115 (Vernon 2003).
