MEMORANDUM OPINION

ANDRE M. DAVIS, District Judge.

This is a civil rights action instituted pursuant to 42 U.S.C. § 1983 by a police official who principally contends that he was the victim of unlawful retaliation in violation of his rights under the First Amendment.1 Now pending is defendants' motion to dismiss the federal claims pursuant to Fed.R.Civ.P. 12(b)(6).
