In December 2003, Harold Jenkins sued the Village of Maywood and several of its employees, asserting claims under Title VII and 42 U.S.C. § 1983. On March 9, 2004, the parties filed a joint stipulation (hereafter "Stipulation") for voluntary dismissal without prejudice, pursuant to Fed. R.Civ.P. 41(a)(1)(ii).
