George Gordy was charged by accusation with driving under the influence and possessing an open container of alcohol. The judge, sitting without a jury, found Gordy guilty of both charges. Gordy filed a motion for a new trial contending, among other things, that the court erred in denying his motion to quash the accusation because it did not allege venue. The trial court denied the motion as to Count 1(DUI), but agreed with Gordy's argument...
