In March 2000, Fischer Investment Capital, Inc. ("Fischer") loaned $207,000 to Avie Cohen and his company, The Joblotter Inc. ("Joblotter"). The loan was secured by, among other things, Joblotter's accounts receivable. When Cohen failed to timely repay the debt, Fischer sued and won a default judgment against Cohen in state court.
