OPINION BY Chief Justice LEROY R. HASSELL, SR.

In this appeal, we consider whether the driver of a vehicle was involved in an accident within the intendment of Code § 46.2-894, a penal statute. This statute states in relevant part:

"The driver of any vehicle involved in an accident in which a person is killed or injured or in which an attended vehicle or other attended property is damaged shall immediately stop as close to the scene of the accident...
