We withdraw our previous opinion and judgment dated July 12, 2007 and issue the following opinion in its stead. See TEX.R. APP. P. 50.

Appellant, Victor Lamont Mims, appeals from a jury verdict that found him guilty of murder. See TEX. PEN.CODE ANN. § 19.02(b) (Vernon 2003). After the jury found him guilty as charged in the indictment, the trial court assessed his punishment at life imprisonment...
