Petitioner Delores Coleman (hereinafter petitioner), a correction officer with respondent Department of Correctional Services (hereinafter respondent), was injured on February 13, 2003 in an off-duty automobile accident. When her absence exceeded one year, respondent informed her that as of February 17, 2004, she would be terminated pursuant to Civil Service Law § 73.
