The issue on this appeal is whether the criminal complaint filed against Dawn Dartez alleges facts that constitute a violation of WIS. STAT. § 346.67(1) (2005-06),1 Wisconsin's "hit-and-run" statute. The circuit court determined that an "accident" in § 346.67(1) must occur on a highway and the facts alleged show that the accident occurred off the highway because that is where the collision occurred.
