Before the Court are motions by Cannon Cochran Management Services, Inc. ("CCMSI") and the City of New Orleans ("City") to Dismiss Third Party Demand for Lack of Subject Matter Jurisdiction and Alternatively, Rule 12(b)(6) Motion for Failure to State a Claim (Rec. Does. 44 & 55). For the reasons stated below, the motions are DENIED.
