The original plaintiff in this case settled his case against the defendants prior to his death. After his death, his succession entered the litigation as the proper party plaintiff and caused the matter to be dismissed. Subsequently, two of the plaintiff's adult children had themselves substituted as proper party plaintiffs and filed a motion to vacate the dismissal.
