After an automobile accident and subsequent personal injury judgment against him that exceeded his policy limits, Shane McKinley, the appellant, sued his insurer, Guaranty National Insurance Company ("GNIC"). His claims included bad faith in handling the personal injury claim, breach of contract and intentional infliction of emotional distress (IIED).
