In 1999, defendant Robert Gioia negotiated the purchase of a 1988 Advantage Warrior motorboat to be used for recreational purposes. Title was placed solely in the name of his wife, defendant Linda J. Gioia. On July 4, 2002, the boat flipped to the left and capsized while being operated by a relative of the Gioias. As a result, Robert Gioia brought the boat to defendant Francis A.
