On 6 October 2004, the defendant, Kendall Copelin ("Copelin"), was charged by a bill of information with one count of possession with intent to distribute crack (count one) and one count of distribution of marijuana (count two). On 12 October 2004, he entered pleas of not guilty to both counts.
