OPINION

COATS, Chief Judge.

Douglas W. Artemie was tried on two counts of first-degree sexual assault and one count of first-degree assault. The jury could not agree on a verdict. On its first day of deliberations, the jury sent two notes to Superior Court Judge Larry D. Card telling him that it was deadlocked. Judge Card responded to both notes by telling the jury to continue deliberations.
