Both the respondent's attorney, Nicholas C. Cooper, and the Clerk of the New York State Supreme Court, Queens County, have apprised the Court of the respondent's conviction on August 28, 2006, of scheme to defraud in the first degree, in violation of Penal Law § 190.65 (1) (b), a class E felony.
