OPINION

TERRY JENNINGS, Justice.

A jury found appellant, Robert Anthony Porteous, guilty of the offense of attempted capital murder of a peace officer1 and assessed his punishment at confinement for thirty-seven years and a $5,000 fine. In two points of error, appellant contends that the trial court erred in (1) denying his motion to suppress evidence in violation of the Fourth Amendment to the United States Constitution
