THE PEOPLE OF THE STATE OF NEW YORK, Respondent, v. RICKY TURNER, Appellant.

Spain, J.

Defendant pleaded guilty to one count of criminal possession of a controlled substance in the fourth degree in satisfaction of an eight-count indictment, following the recovery of a quantity of cocaine from an apartment in which defendant was present. Defendant executed a waiver of his right to appeal and was sentenced as a second felony offender, in accordance with the plea agreement, to a prison term of 3½ to 7 years. Defendant now appeals.
