MEMORANDUM OPINION AND ORDER

JACKSON, District Judge.

This matter comes before the Court on Plaintiff's Motion for Partial Summary Judgment and Defendants' Cross-Motion for Partial Summary Judgment. The Court conducted a hearing on July 17, 2006.1 For the reasons outlined below, Plaintiff's Motion for Partial Summary Judgment is GRANTED. Defendants' Cross-Motion for Partial Summary Judgment is DENIED.
