In October 2000, defendant was indicted for the crimes of rape in the first degree, sodomy in the first degree, incest and sexual abuse in the first degree stemming from a sexual assault upon a family member. In July 2001, following the impaneling of a jury, defendant elected to plead guilty to sexual abuse in the first degree in full satisfaction of the indictment.
