As the result of an argument which occurred outside of a Queens bar that rapidly escalated into a violent confrontation between the defendant and the deceased, Diogenes Fermin, and a friend of Mr. Fermin's named Jerry, the victim was killed during the early morning hours of May 20, 2006.
