THE PEOPLE OF THE STATE OF NEW YORK, Respondent, v. ROBERT FELLER, Appellant.

While on probation, defendant was charged by indictment with assault in the first degree, reckless endangerment in the first degree and endangering the welfare of a child. Pursuant to a negotiated plea agreement, defendant pleaded guilty to assault in the second degree and violation of probation and waived his right to appeal. Defendant thereafter was sentenced, as a second felony offender, to concurrent prison terms of 1 to 3 years on the probation violation...
