Swain, 112 Haw. 184, 145 P.3d 727 (2006) [hereinafter, "Willis I"], the plaintiff-appellant Shilo Willis requests fees and costs pursuant to Hawai`i Rules of Appellate Procedure (HRAP) Rule 39 and Hawai`i Revised Statutes (HRS) § 431:10C-211 (2005).1
